Executive Summary: On February 28, China’s National People’s Congress (NPC) Standing Committee passed the first comprehensive Food Safety Law (FSL) after five years of drafting; the first draft was read in December 2007. The FSL will go into effect on June 1, 2009. On April 24, the State Council published the first set of implementation regulations related to the new law. The Legislative Affairs Office of the State Council (SCALO) is seeking public
comments on this regulation by May 4, 2009. The original draft in Chinese can be found at

According to Chinese Government contacts, this implementation regulation will be followed by regulations by the Administration for Quality Supervision, Inspection, and Quarantine (AQSIQ), State Administration of Industry and Commerce (SAIC), and the Certification and Accreditation Administration (CNCA) of China.
Neither the Food Safety Law (CH9019), nor this regulation has been notified to the World Trade Organization.
